By the numbers

How dangerous is a head-on collision?

Head-on collisions are rare. That is what makes these numbers so stark: they are a small slice of the crashes on our roads and a large slice of the deaths.

Maryland does not publish a head-on crash count, so we calculated one

MDOT breaks Maryland crashes down by county, by month and by severity, but not by collision type. There is no official Maryland head-on number to quote. So we went to the federal Fatality Analysis Reporting System, which records every fatal crash in the country, and pulled the Maryland crashes coded front-to-front, which is the federal coding for a head-on collision. As a check on the method, the same query returns 577 fatal crashes and 621 deaths for Maryland in 2023, matching MDOT's own published totals exactly.

One caution if you are comparing numbers. Maryland's Zero Deaths dashboard does show a Head On category, but it is broader than the federal one, because it also counts left-turn and angle crashes. The two figures are not the same statistic and should not be treated as interchangeable.

A rare crash that accounts for a lot of the deaths

Montgomery County is the one place in Maryland that publishes collision type alongside severity for every reported crash, which lets you see both halves of the picture at once. From 2019 through 2023, head-on collisions were 2.2 percent of the county's crashes and 8.9 percent of its fatal crashes. That is the same roughly fourfold gap the national data shows. A head-on crash there was about 25 times more likely to be fatal than a rear-end crash.

Two honest caveats on that county data. It covers 16 fatal head-on crashes over five years, which is a small enough number that the percentages should be read as approximate. And Montgomery County changed how it codes collision type in 2024, so later years cannot be added to the same count.

A head-on collision is the deadliest way two vehicles can hit each other. It is not the deadliest crash on the road, because crashes that begin with a vehicle striking a person on foot are deadlier still. But no vehicle-to-vehicle impact carries the same risk, and that is why these cases are worth taking seriously from the first day.

Why it happens

What causes most head-on collisions in Maryland?

Common causes

When it comes to head-on collisions, you are going to want to have a better understanding of the root cause. This can go a long way in putting together a comprehensive legal claim that works out in your favor. If you were in a head-on collision, it's best to get a police report filed on the case. This will shed light on what the main cause was and it is going to be cited in the police report.

Why head-on crashes are so dangerous

Head-on crashes are among the deadliest on the road. When two vehicles hit front-to-front, their speeds combine, so a wreck at even moderate speeds can carry the force of a much faster impact. That is why head-on collisions so often cause life-changing injuries — and why these claims deserve serious attention.

Step by step

What to do after a head-on collision in Maryland

A head-on collision is overwhelming. Once you know everyone is okay, it's time to look at your options. We've helped thousands of Maryland clients build a strong legal strategy under Maryland law — you're in good hands.

1

Call 911 and get medical care

If you are able: call 911 and get medical care right away, even if you feel okay.

2

Document the scene

Move to safety, photograph the vehicles and the scene, and get the other driver's information and any witness contacts.

3

Don't talk to the insurer without us

Do not admit fault or give the other insurer a recorded statement. Then call us before you talk to their adjuster.

Know your rights

What does Maryland law say about fault in a head-on collision?

Statute of limitations: three years from the date of the crash (Md. Code, Courts & Judicial Proceedings § 5-101). Miss that deadline and you're permanently barred from recovering — even a lawsuit filed one day late is barred. Shorter deadlines apply when a government vehicle or agency is involved, often a one-year notice requirement, so talk to a lawyer quickly.

Economic damages

This is going to include everything that is tangible and costs you money out of your pocket. A good example of this would be car repairs, medical bills, prescription fees, and a loss of income. If you have had to pay for something out of your pocket, it needs to be included in the claim.

Non-economic damages

The goal is to highlight pain and suffering. For example, a person that has been dealing with PTSD since the accident can list this in the claim. You could also pinpoint how you are not able to do the things that you used to in the past.

Punitive damages

They are only awarded in situations where the defendant's actions were malicious. In other words, the defendant intended to cause harm to the victim. There's no cap on punitive awards in Maryland, unlike in many other states.

How much will an attorney cost?

We are going to have a contingency fee for all of our cases. This means you are only going to pay when we win the case and it is going to be a small percentage of the compensation. We are not going to request funds before the case is concluded.

The money question

Who pays, and what's my Maryland head-on collision case worth?

Every car accident case is unique, and the amount you recover depends on the circumstances — as determined by the insurance company or a jury. Factors that affect your settlement's value include:

  • Extent, severity, and duration of your injuries
  • Property damage to each vehicle
  • Mechanism of injury and whether it's temporary or permanent
  • Pre-existing injuries and whether they're directly related to the crash
  • Time lost from work and the credibility of each driver

How much is my case worth?

What actually moves the number in a head-on case

Head-on crashes produce the most severe injuries per collision of any crash type, and the damages calculation usually reflects that without much argument. What gets fought over is coverage. A catastrophic injury will routinely exceed the at-fault driver’s policy, and when it does the question becomes what other insurance can be reached — underinsured motorist coverage on your own policy, a resident relative’s policy, an employer’s policy if the other driver was working.

The second question is why the vehicle crossed the centerline. Impairment, a medical event, a defective road design or a distracted driver each open different avenues, and some of them reach defendants with far more coverage than the driver. That investigation is worth more to the final number than any adjustment to the multiplier.

How Maryland personal injury settlements are calculated — the multiplier and per diem methods, the damages caps, the deadlines, and our settlement calculators.

No two cases are worth the same, but insurers lean on two common methods to estimate pain and suffering. Understanding them helps you spot a lowball offer. Try our free Maryland Car Accident Settlement Calculator for a personalized estimate.

Should I speak to the insurance company?

We generally advise against it. Insurers will most likely make an immediate offer well below the true cost of your damages. If you work with us, we handle all discussions and negotiations so you're protected from being victimized in the claims process.

Should I accept their offer?

The adjuster's first offer is in most cases very low and doesn't represent what the case is actually worth. Negotiations typically go back and forth for a few months before settling — at which point we file a lawsuit based on the value of the case.

Where Maryland head-on collisions happen

Serious head-on collisions cluster on the same high-traffic corridors across Maryland. Here is where we see the worst head-on collisions and where injured drivers are treated.

3.8%Maryland's fatal head-on crashes in 2024 that happened on an interstate. These crashes concentrate on arterials and collectors, not highways.Source: Pinder Plotkin analysis of NHTSA Fatality Analysis Reporting System data, 2024

The road where you are most likely to meet a car coming at you is not the highway. It is the two-lane road with a double yellow line and nothing else in between. Federal Highway Administration research says a lot of that is fixable: center line rumble strips can cut rural head-on and sideswipe fatal and injury crashes by up to 45 percent, widening the buffer between the two center lines on a rural two-lane road can cut head-on crashes by 25 to 90 percent depending on the width, and a median barrier on a rural divided highway can cut fatal and injury cross-median crashes by up to 96 percent. When a road with a known head-on history has none of that, it is worth knowing in your case.

Jason, Charlotte, and Tony were absolutely amazing! I was in a car accident 4 years ago, they made sure I was taken care of and even though we had a lot of set backs due to Covid, they never made me feel like my case (or me) were not important. Tony knew my medical history better than I did, Charlotte was always an absolute delight to talk to and was so kind, and Jason was just great! I'm really sad that I won't be talking to them anymore, they became like family! I know that is something a lot of people say, but it is 100% true with this team.More

Maryland Head-On Collision FAQs

How long do you have to file a head-on collision claim in Maryland?

There is a statute of limitations on head-on collisions. You are going to have three years and the clock is going to start ticking once the collision occurs. This means you have to act fast and look to file the claim within this timeline.

How does Maryland's contributory negligence rule affect a head-on case?

Head-on crashes can raise fault questions — who crossed the center line, who had time to react. That matters in Maryland, because our contributory negligence rule can bar your recovery entirely if you are found even 1% at fault. The other driver's insurer will look hard for any way to share the blame, so we build your side of the story early and carefully.

Why does following up with your doctor matter so much?

Gaps in treatment are one of the first things an insurer uses to argue you were not really hurt. Following your doctor's plan protects your health and your claim at the same time. Keep your appointments, follow the recommendations, and tell us if cost or transportation is a barrier — we can help.

Why choose the Pinder Plotkin legal team for your head-on case?

From our three Maryland offices in Baltimore (Nottingham), Laurel and Bel Air, we represent people hurt in head-on crashes across Baltimore City, Baltimore County, Anne Arundel, Howard, and Harford counties. We move quickly to preserve evidence, value your claim honestly, and stand between you and an insurer that wants to pay as little as possible. The consultation is free, and there is no fee unless we win.

What causes most head-on crashes in Maryland?

Crossing the center line is the common thread — usually from distraction, impairment, fatigue, or an unsafe pass on a two-lane road. Wrong-way entries onto divided highways are rarer but almost always catastrophic. Establishing which vehicle left its lane, and why, is the heart of the case.

What is a head-on collision claim worth in Maryland?

It depends on the injuries, the treatment you need, and the insurance actually available — not on a formula. Head-on impacts combine both vehicles’ speeds, so injuries tend to be severe and the at-fault driver’s minimum policy of $30,000 is often exhausted quickly. Your own underinsured motorist coverage frequently becomes the real source of recovery.

What if the other driver died in the crash?

You can still bring a claim. It proceeds against the deceased driver’s insurance policy and, where appropriate, their estate. It feels uncomfortable to many people, but the practical reality is that you are claiming against an insurer, not against a grieving family.

Who pays if the other driver crossed the center line because of a medical emergency?

This is one of the genuinely difficult ones. Maryland recognizes a sudden-incapacity argument, and whether it succeeds turns on whether the emergency was truly unforeseeable — a first-ever seizure is treated very differently from a known, untreated condition. These cases need the driver’s medical history pulled early.

What is Jake’s Law in Maryland?

Jake’s Law is Maryland Transportation Article section 21-1124.3. It makes it a crime to cause a crash that kills or seriously injures someone while texting or using a handheld phone behind the wheel. A conviction carries up to one year in jail, a fine of up to $5,000, or both, and that sentence is separate from any other charge brought over the same crash. The law is named for Jake Owen, a five-year-old boy killed when the family car was struck from behind by a driver on a cell phone, and it was signed in April 2014 after his parents campaigned for it. If a distracted driver hurt you, a Jake’s Law charge is a criminal matter handled by the State. Your civil claim for medical bills, lost income and pain is separate, and you can bring it whether or not the driver is charged.

What is the negligence rule in Maryland, and can I still recover if I was partly at fault?

Maryland is one of a small number of states that still follows contributory negligence. In most states, being found partly at fault reduces what you recover. In Maryland it can bar your claim entirely, even if the other side was far more to blame. Maryland’s highest court reaffirmed the rule in Coleman v. Soccer Association of Columbia, 432 Md. 679 (2013), over a strong dissent, and said any change to it is for the General Assembly rather than the courts. That is why an insurance adjuster’s first move is so often to suggest you did something wrong. Being blamed is not the same as being at fault, whether the rule actually bars a claim depends on the specific facts, and it is the reason to be careful about what you say and to get advice early.
